A structure linked to Cantor Fitzgerald, controlled by US Commerce Secretary Howard Lutnick, has filed a lawsuit against DraftKings and FanDuel for violating five patents related to mobile betting technologies.

Two of these patents were personally developed by Lutnick in collaboration with former Cantor Gaming employees. After his appointment as Commerce Secretary, he stepped down as CEO of Cantor Fitzgerald for ethical reasons.

In US legal practice, companies accused of patent infringement usually petition the US Patent and Trademark Office (USPTO) to invalidate patents. However, USPTO operates under the Department of Commerce, currently led by Lutnick himself, which puts DraftKings and FanDuel in a difficult position as they must request patent cancellations from an agency headed by their adversary.

Cantor Fitzgerald is a major financial firm founded in 1945, recognized for its activities in brokerage, investment services, and financial operations. It holds significant influence in the gambling and sports betting industry through its subsidiary, Cantor Gaming.

This case highlights potential conflicts of interest between government authority and private enterprise, as well as the challenges companies face regarding technological patents.

A tense legal battle is expected ahead, which may impact the US mobile betting market and patent regulation.
