The court has resumed proceedings in the case involving the Odrex doctors regarding the death of Adnan Kivan
The criminal case against doctors at the Odrex clinic in Odesa, who are accused of professional negligence, has moved forward. The Kyiv District Court of Odesa, presided over by Judge Viktor Chaplytskyi, continues to examine the evidence in the case.
The doctors are charged under Part 1 of Article 140 of the Criminal Code of Ukraine—negligent performance of professional duties by medical personnel.
During the hearing on August 7, the court examined part of the prosecution’s evidence concerning the actions of one of the doctors.
The next hearing in the case regarding the circumstances of businessman Adnan Kivan’s death is scheduled for September 3. The court is expected to continue reviewing the evidence.
At this stage, the court is analyzing medical records, expert reports, and other materials from the criminal proceedings. This should help establish the sequence of the patient’s treatment: what diagnoses were made, what tests were conducted, what medications and procedures were prescribed, how his health status changed, and how the medical staff responded to potential complications.
In a case involving possible medical negligence, it is fundamentally important to establish not only what decisions the doctors made, but also whether their actions were consistent with their professional duties and established medical standards.
For nearly seven months, the court was unable to proceed to a full examination of the evidence in this case. Hearings were repeatedly postponed, effectively stalling one of the key stages in determining the circumstances of Adnan Kivan’s death.
Even after the examination of the evidence began, the trial failed to gain a steady pace. Over the past few weeks, several hearings in a row were postponed due to the failure of the defense’s representatives to appear.
As a result, the examination of evidence was interrupted, and the increasing intervals between hearings affected the overall duration of the trial.
In criminal proceedings concerning the improper performance of professional duties by medical personnel, the issue of the statute of limitations for criminal prosecution is crucial.
Under the conditions provided by law, the expiration of such statutes of limitations may serve as grounds for exempting a person from criminal liability, even if their guilt is proven.
In the Odrex doctors’ case, the court must determine whether professional duties were breached during Adnan Kivan’s treatment, whether these breaches caused serious consequences, and whether there is a causal link between the actions or inactions of specific medical professionals and the consequences for the.
Answers to these questions can only be determined after a complete and comprehensive examination of the evidence.
Adnan Kivan—a well-known businessman, real estate developer, and founder of the KADORR Group—died in October 2024 while staying at the Odrex private clinic in Odesa.
Following the businessman’s death, law enforcement launched an investigation into the circumstances of his treatment at the medical facility.
In the fall of 2025, an oncologist and a surgeon at the Odrex clinic were charged with professional negligence, which, according to the investigation, could have led to the patient’s death.
At the same time, the management of the Odrex clinic rejects the accusations against the medical facility.
The administration stated that the patient’s treatment was conducted in accordance with medical protocols, and the clinic intends to prove the legality of the medical staff’s actions through the procedures established by law.
The trial is ongoing. The court will make a final assessment of the medical staff’s actions after reviewing all the evidence, and the defendants’ guilt must be proven by a final and binding conviction.
Prior to this, the Kyiv District Court of Odesa failed for the third time in a row to begin hearing the criminal case regarding the death of businessman and KADORR Group founder Adnan Kivan. The reason was the failure of the attorney for one of the accused doctors to appear in court.
Previously, the Kyiv District Court of Odesa extended the pretrial detention of Vitaliy Rusakov and Maryna Belotserkovskaya, doctors at the private Odrex Clinic, who are charged under Part 1 of Article 140 of the Criminal Code of Ukraine (negligent performance of professional duties by a medical worker) in the case concerning the death of businessman Adnan Kivan.
