The Supreme Court has definitively granted the monastery in Knyazhychi to the OCU on a lease

The Supreme Court has issued a final ruling in the case concerning the complex of buildings belonging to the Transfiguration Monastery in the village of Knyazhychi, Kyiv Oblast. 

This was reported by Roman Tytikalo, a member of the Kyiv Regional Council.

The high court confirmed the legality of leasing the property to the Orthodox Church of Ukraine, putting an end to the long-standing legal dispute with representatives of the Ukrainian Orthodox Church (Moscow Patriarchate).

The conflict began back in 2022, when the Brovary City Council conducted an inventory of community property. 

The inspection revealed numerous violations: some of the structures on the monastery grounds had been built without permits, and the land plots were being used without authorization.

Based on these facts, the city council terminated the right of use of the land for the religious community of the UOC (MP) and concluded an official lease agreement with the OCU. 

Roman Tytikalo noted that representatives of the Moscow Patriarchate refused to voluntarily leave the territory, which forced the OCU to go to court.

The courts of first and appellate instances fully upheld the claims of the Orthodox Church of Ukraine. 

They confirmed the legality of the local government’s actions and ruled on the forced eviction of the previous occupants from the illegally occupied premises.

The Supreme Court, having considered the cassation appeal, left the previous decisions unchanged. This effectively means full support for the community’s legal position and recognition that the property belongs to the OCU in accordance with the concluded lease agreement.

“This decision effectively concludes the long-standing legal dispute over the use of community property and paves the way for the implementation of the Brovary City Council’s decision,” emphasized Roman Tytikalo. 

From now on, all legal grounds exist for the enforcement of the court verdict and the physical vacating of the buildings.

As a reminder, the DECR recognized the Kyiv Metropolis of the UOC as affiliated with the Russian Orthodox Church.

Also, another conflict broke out in Varash between the UOC-MP and the OCU over a church.
