Meta challenges UK Ofcom decision on WhatsApp and Instagram — Anadolu Agency
Meta has launched a new legal challenge against a decision by the UK regulator Ofcom concerning the application of the Online Safety Act. The company is challenging the classification of WhatsApp and Instagram as platforms subject to additional obligations.
Requirements for platforms
As reported by Anadolu Agency, Meta’s lawyers have filed an appeal against Ofcom’s decision. According to The Guardian, the additional obligations provide for a higher level of transparency, expanded control options for users, as well as measures against fraudulent advertising and illegal content.
Meta said that its challenges are not directed against the law itself, but concern how Ofcom interprets it. The company considers such legal proceedings a normal part of shaping a new regulatory regime, which should contribute to the proportionate, accurate and consistent application of the rules.

Other disputes with Ofcom
In May, Meta also challenged Ofcom’s methodology for calculating regulatory fees. The company stated that such fees should not be determined on the basis of its global revenue.
The Online Safety Act provides for fines for companies of up to 10% of relevant worldwide revenue or £18 million, whichever is greater. TikTok and X are also taking legal action over the amount of information they must provide to Ofcom.
Ofcom’s online safety director, Oliver Griffiths, told a House of Lords committee that the regulator is operating amid a large number of legal disputes. According to him, Ofcom seeks to implement the legislation effectively, but may face significant legal consequences in the event of unjustified risks. The government stated that it will continue to introduce legislation to regulate the internet as technology develops.
