South Africa submits new dossier to ICJ on Israel’s compliance with provisional measures
At the end of August, South Africa submitted a new dossier to the International Court of Justice (ICJ) containing information on Israel’s compliance with provisional measures in the case brought by South Africa. The document was referred to a committee of judges that reviews information regarding compliance with such measures, Daily Maverick reports.
South Africa’s Department of International Relations and Cooperation said the dossier was submitted pursuant to Article 11 of the ICJ’s Rules of Court. Under this provision, the committee considers information provided by the parties concerning provisional measures.
South Africa’s data on the situation in Gaza
The department said that, as of August 2026, at least 73,407 Palestinians had been killed in Gaza and 174,335 injured since October 7, 2023. According to the ministry’s assessment, 46,000 surviving Gaza residents, including children, have severe conflict-related injuries, including amputations and traumatic brain and spinal cord injuries.
South Africa also claims that after the announcement of the so-called ceasefire, Israeli forces killed an average of one Palestinian child per day. The department reported a more than threefold increase in the miscarriage rate in Gaza during 2026, as well as shortages of water, medical care, medicines and other resources needed for survival.

The ICJ issued three legally binding orders on provisional measures concerning Israel to protect Palestinians’ rights under the Genocide Convention. The court noted that there was a real and imminent risk of irreparable prejudice to Palestinians’ rights in Gaza to be protected from genocide. South Africa says Israel has not complied with these orders; Amnesty International has also stated that the provisional measures have not been complied with.
Criticism of coal exports
University of Johannesburg researcher Steven Friedman and Na’eem Jeenah, a senior researcher at the Mapungubwe Institute for Strategic Reflection, told the publication that the new dossier could strengthen South Africa’s arguments in the main case. They also criticized the country’s government over the continued export of coal to Israel.
According to Daily Maverick, shipments of South African coal account for a small share of South Africa’s total exports but form a major part of Israel’s coal imports. Jeenah called the authorities’ position problematic, saying they view coal sales as a private-sector matter unrelated to government actions.
