The court fully acquitted the former director of Naftogaz Trading in the case involving the embezzlement of bonuses
The Shevchenkivskyi District Court of Kyiv fully acquitted Vitalii Volynets, the former director of Naftogaz Trading Gas Supply Company LLC.
He was accused of embezzling and misappropriating 1.74 million hryvnias through the illegal accrual of bonuses.
The court concluded that the official’s actions did not constitute a criminal offense.
According to the prosecution, between November 2018 and March 2019, the company’s head unjustifiably paid funds to himself and his subordinates.
The investigation insisted that Volynets approved the Bonus Regulations by his own order, bypassing the consent of the general meeting of the founder—DK “Gaz Ukrayiny.”
Prosecutors pointed to the absence of a collective agreement and proper justification for making the relevant payments.
According to law enforcement officials, such actions by the head of LLC “GC “Naftogaz Trading” caused the company significant financial losses. The case was investigated under Part 5 of Article 191 of the Criminal Code of Ukraine.
During a detailed analysis of the circumstances of the case, the court determined that the approval of the internal regulations did not require mandatory approval by the company’s founders.
Consequently, this document was recognized as a legal basis for calculating monetary bonuses for employees until the collective agreement was concluded.
The court found that the bonus procedure was based on memos from department heads and a detailed financial analysis by the accounting department.
In addition, the payments were agreed upon verbally during regular meetings with the director of the state-owned company “Gaz Ukrayiny.” The court found no violations in this practice.
