A German tourist won a court case seeking compensation for the lack of lounge chairs at a hotel

A tourist in Greece secured a payout after filing a complaint against a hotel. The man claimed that, despite paying €7,000, he was unable to use the lounge chairs because they were constantly occupied, so he filed a complaint with the tour operator and subsequently received compensation.

The Guardian reports on this.

 

A tourist from Germany was vacationing on the island of Kos in Greece in 2024. The man traveled with his wife and children, spending €7,000 on the trip.

However, during his stay, he was never able to use the lounge chairs. According to him, all the lounge chairs were constantly occupied by other vacationers’ towels. Every morning, he woke up before dawn to find free lounge chairs, but they were already “reserved.” As a result, his family had to lie on the concrete instead of on the lounge chairs.

Eventually, the man filed a complaint against the hotel, after which the Hanover District Court ruled to award the tourist compensation in the amount of €986.70. Liability for the incident will be borne by the German tour operator who arranged the family’s vacation. As the judge noted, the decision was made “in light of the specific circumstances” of the case.

During the trial, the tourist stated that the tour operator and hotel staff failed to ensure that all lounge chairs were not occupied by towels. Furthermore, after the complaints, the hotel staff did not respond to the tourist’s requests. The court also noted that tourists cannot be guaranteed a lounge chair at any given moment, but the tour operator and the hotel were required to ensure that there were enough lounge chairs for all guests.

Incidentally, the legal publication Legal Tribune Online noted that the tour operator would be held liable under German laws governing package tours. Under this law, the hotel is considered part of the services provided by the tour operator in such situations.
