US proposes ending 60-day grace period for foreign workers
The United States has proposed abolishing the maximum 60-day grace period for certain foreign workers, including H-1B visa holders who have lost their jobs. If the rule is finally approved, workers whose employment ends before their visas expire will have to leave the country immediately unless they have separate authorization to remain.
Who will be affected by the changes
The US Department of Homeland Security proposal provides for abolishing the discretionary grace period of up to 60 days. It currently applies to workers with E-1, E-2, E-3, H-1B, H-1B1, L-1, O-1 and TN nonimmigrant statuses who have lost their jobs, as well as their family members.
