Australian court: woman not criminally responsible — ABC News Australia

The Supreme Court of New South Wales in Australia found that a woman from the Blue Mountains area is not criminally responsible in the case involving the killing of her two sons, aged nine and 11. According to the court, the boys were stabbed to death by their mother in September 2024. The children were later found in the family home by their father, who called emergency services.

Court decision

The accused pleaded not guilty to the murder charges on the grounds of a mental disorder. Justice Richard Cavanagh delivered a special verdict: the act was proven, but the accused is not criminally responsible.

As ABC News Australia reports, the judge said psychiatric opinions convincingly indicated that the woman understood the nature of her actions but did not understand that they were wrong.

Psychiatrists’ findings

Three psychiatrists interviewed the accused separately several times via audiovisual link. According to the judge, their conclusions largely coincided: at the time of the incident, the woman had such severe depression that her thinking had become psychotic.

The experts also believed that she was unable to reason other than to think that her children would be better off dead in a world she perceived as too bad.

Further detention

The woman will be detained at a place determined by the Mental Health Review Tribunal. This body will supervise her and must ensure appropriate assistance and treatment. She cannot be released until the tribunal is satisfied that doing so would not pose a serious danger to herself or others.
