A court in India denied a civil servant's request for maternity leave for her fourth child
The Allahabad High Court in India dismissed a lawsuit filed by civil servant Shashi Kumari, who had requested maternity leave for her fourth child. The court noted that under current regulations, she is not entitled to such leave.
Judge Manju Rani Chauhan issued her ruling on Kumari’s lawsuit on August 7. She had challenged a June 19 decision in which the Block Education Officer in Sambhala (Bhim Nagar) denied her maternity leave for her fourth child.

Kumari also asked the High Court to order the relevant authority to grant her the six months of such leave provided for by law. Her attorney stated that she had not taken leave after the birth of her three previous children, so, in his opinion, she was eligible for it for the first time. The attorney called the education official’s decision unfounded.
A representative of the authorities objected to the lawsuit, citing regulations under which an employee is not entitled to leave for a fourth child. He also pointed out a statement in the complaint itself, according to which Kumari had already taken leave in connection with her pregnancy and childbirth. The court took the government representative’s position into account, found no grounds for intervention, and dismissed the complaint.
