South African Electoral Commission registers party without abbreviated name

In South Africa, the Electoral Commission registered the United Democratic Front Party without an abbreviated name after reconsidering the case as ordered by the Electoral Court. Earlier, the deputy chief electoral officer rejected its application because the UDFP abbreviation was impermissibly similar to the name of another political party.

As Daily Maverick reports, after the rejection, the party appealed the decision to the commission. It asked to be registered without an abbreviation or to be allowed to use one of several other abbreviated names. The commission refused, as it could not simultaneously be an arbiter and a participant in the process, and also noted the need to publish a notice of the application without an abbreviated name.

Electoral Court decision

The party applied to the Electoral Court, which set aside the commission's decision and referred the case back for reconsideration. The court ordered the commission to decide within seven days on registering the party without an abbreviated name. If the commission considered it necessary to publish a notice of registration, it had to notify the party within three days after reconsidering the appeal.

The commission complied with this instruction by registering the party without an abbreviation and declining to publish a notice of the amended application. The column states that the possible consequences of this decision should be mitigated by publishing the party's certificate. The initial notice of its application was published on December 23, 2025, during the holiday period.

Issue of procedural rules

The author of the Daily Maverick column believes that the main subject of the dispute was not the similarity of the names, but compliance with procedure — in particular, the need to publish the amended application. In his view, the commission must strictly verify legal formalities and threshold requirements before assessing the substance of an application.

The author also raises the question of whether an electoral body may relax procedural rules for parties — for example, regarding the publication of applications, the required number of supporters' signatures, or the amount of the deposit when nominating candidates. He believes that strict compliance with such requirements promotes predictability and the integrity of the electoral process.
