Pakistan’s Supreme Court emphasizes wife’s right to mahr — Dawn
Pakistan’s Supreme Court, in a ruling on disputes related to entries in the nikah marriage contract, emphasized that mahr is the wife’s legal right, not a favor from the husband or a means of pressure. As Dawn reports, the court stated that mahr must be paid in good faith, within the agreed timeframe, and without conditions that may humiliate or pressure a woman.
Conditions for paying mahr
According to the publication, the court noted that a husband cannot tie the payment of mahr to his wife’s behavior or to her not seeking a divorce. Such conditions contradict the purpose of mahr.
Dawn notes that disputes over mahr often become part of prolonged family conflicts. In such cases, women have to go to court for years to obtain what was promised when the marriage was concluded.

Formalizing the marriage contract
The court also drew attention to the formalization of nikah. Registrars must carefully record the terms of the contract, including provisions on mahr, property, and the delegated right to divorce.
The relevant entries should be explained to the parties before they sign or affix their fingerprints. Property transferred as mahr must be described specifically enough to be identified.
Local councils were also instructed to train registrars, verify registration records, and take action against those who improperly perform their duties. In Dawn’s view, proper formalization of a marriage contract can prevent disputes over the parties’ agreements and the possibility of enforcing them.
