The prosecutor's office is seeking a court order to return 9.4 hectares of land to Kyiv

The prosecutor’s office is seeking a court order to terminate a lease agreement for a land plot in Pechersk valued at over 114 million hryvnias. The plot covers an area of more than 9.43 hectares, part of which consists of water. According to the prosecutor’s office, the lessee has not begun construction in over 21 years and has also subleased part of the land without the city’s approval.

 

The Pechersk District Prosecutor’s Office has filed a lawsuit with the Kyiv Commercial Court regarding the land plot on Naberezhno-Pecherska Road. The prosecutor’s office is asking the court to terminate the lease agreement early and return the land to the city. The plot covers an area of more than 9.43 hectares, of which 5.29 hectares are water. The land is valued at more than 114 million hryvnia.

According to the prosecutor’s office, the Kyiv City Council had previously leased this territory for the construction of a recreational area with a community center. However, more than 21 years have passed, and construction has yet to begin. During an inspection of the site, law enforcement officers found no buildings, real estate, or equipment there. There were also no visible signs of any construction work having taken place.

Instead, according to the prosecutor’s office, the plot itself has become overgrown with trees and shrubs. The violations identified by the prosecutor’s office do not end there. The company subleased part of the leased land. However, as the prosecutor’s office notes, they did not obtain permission from the Kyiv City Council to do so, even though this condition was stipulated in the contract. Another issue was the rent. According to the prosecutor’s office, the tenant systematically violated the terms of the agreement and failed to pay rent on time and in full.

 

The prosecutor’s office believes that these violations provide grounds for early termination of the lease agreement. Therefore, the Pechersk District Prosecutor’s Office filed a lawsuit with the Kyiv Commercial Court. The court has already opened proceedings on the prosecutor’s claim. Now the court must review the prosecutor’s office’s claims and decide whether to terminate the lease agreement and return the land plot to the city.
