A well-known mineral water producer was fined for unfair competition

The Antimonopoly Committee of Ukraine fined LLC “Ukrainian Mineral Waters Corporation” for unsubstantiated claims regarding the health benefits of “Tonus Kysen” water. It found the company’s actions to be a violation of the law on protection against unfair competition. 

The decision to impose the fine was adopted at a Committee meeting on June 4, 2026, due to the dissemination of false information.

 

During its monitoring, the agency found that the manufacturer’s official website contained claims about the alleged health benefits of “Tonus Kysen” mineral water (specifically, regarding still water in 0.5-liter and 1.5-liter bottles). However, the company was unable to substantiate these therapeutic properties with concrete evidence.

To prove the veracity of its claims, “Ukrainian Mineral Waters” provided the Committee with a series of documents:

  • reports from the State Scientific and Research Institute of Research and Development of the Ministry of Health of Ukraine;

  • official letters from individual doctors.

During its investigation, the AMCU found that these materials did not constitute sufficient evidence. The claims regarding health benefits that the company used on its website were not the subject of any research by the state institute of the Ministry of Health. The Committee emphasized that the reliability of such medical information can be confirmed exclusively by the results of official clinical trials. The letters from doctors provided are merely subjective opinions and lack sufficient scientific justification.

A consumer survey conducted by the AMCU confirmed that the “health benefitsadvertising directly influenced people’s intentions to purchase this particular water. As a result, the company could have gained an unfair competitive advantage over other honest producers and sellers of natural table water.

The business entity fully agreed with the Committee’s conclusions and ceased disseminating false information regarding the water’s health benefits on its website, which was taken into account by the AMCU when rendering its final decision.

Previously, the Antimonopoly Committee of Ukraine had found the actions of Karpatski Mineralni Vody LLC to be a violation of the law on protection against unfair competition. The violation consisted of disseminating false information about the origin of the natural mineral table water “Karpatska Dzherelna.”

As a reminder, the AMCU fined two water utilities over ₴11 million for tariff violations.
