Apple cites new evidence in lawsuit against OpenAI
Apple has filed new materials with the court in its case against OpenAI, stating that its former employee Chang Liu, who now works at OpenAI, used the company’s confidential data and may have been involved in the destruction of evidence. TechCrunch reports.
According to Apple, the new details emerged after Liu’s lawyer provided his former work MacBook for examination at the beginning of the month. The company believes these materials support its accusations of trade secret theft for the benefit of OpenAI.
Apple’s claims
Apple claims that Liu used a confidential Apple electrical circuit diagram in his work at OpenAI, as well as a tool that had the same name as Apple’s internal engineering application. In its court filing, the company also alleges that OpenAI was aware of Liu’s access to Apple data.

According to Apple, in June, when Liu learned that Apple was investigating him, he asked OpenAI colleague Yu-Ting Peng for help destroying evidence. Some of the new evidence has been redacted in the public version of the court documents. In earlier filings, Apple cited Liu’s text messages that, in the company’s view, indicated that he knew he retained access to Apple files.
OpenAI’s position and requests to the court
OpenAI previously stated that Liu accessed Apple files after leaving the company while helping former colleagues at their request. The company also claimed that the issue of residual access is widespread and is linked to inadequate management of access to systems after employees leave.
Apple disputes this explanation, stating that Liu retained access by using a rare, previously unknown authentication flaw. The company is asking the court to issue a preliminary injunction that would prevent OpenAI from working on hardware based on Apple technologies while the case is being heard. Apple is also seeking expedited discovery, as it believes other former employees may be involved in the case. In its original lawsuit, Apple stated that more than 400 of its former employees now work at OpenAI.
