The court has postponed the hearing in the case of Adnan Kivan's death for the third time

For the third time in a row, the Kyiv District Court of Odesa was unable to begin hearing the criminal case regarding the death of businessman and KADORR Group founder Adnan Kivan. The reason was the failure of the attorney for one of the accused doctors to appear.

The case involves surgeon Vitaliy Rusakov and oncologist Marina Bilotserkovska.

The medical professionals are charged under Part 1 of Article 140 of the Criminal Code of Ukrainenegligent performance of professional duties by a medical worker.

According to the investigation, after the surgery, the doctors failed to prescribe the necessary antibiotic therapy to Adnan Kivan and responded inappropriately to postoperative complications.

According to the findings of the forensic medical examination, this, according to investigators, led to the development of sepsis and the patient’s subsequent death.

This is the third court hearing in the past two weeks that could not proceed due to the absence of a representative for the defense.

To date, the trial on the merits of the case has not yet begun.

Adnan Kivan, a well-known businessman, real estate developer, and founder of KADORR Group, died in October 2024 while undergoing treatment at the Odrex private clinic in Odesa.

Following his death, law enforcement launched an investigation into the circumstances surrounding the provision of medical care.

In the fall of 2025, an oncologist and a surgeon at the Odrex clinic were notified of charges of professional negligence, which, according to the investigation, could have led to the patient’s death.

At the same time, the management of the Odrex clinic rejects all charges, emphasizing that treatment was carried out in accordance with current medical protocols, and the clinic intends to prove the legality of the medical staff’s actions exclusively in court.

Under the Constitution of Ukraine, individuals are presumed innocent until their guilt is proven in court and confirmed by a final and binding conviction.

Earlier, the Primorsky District Court of Odesa held another hearing in the case against Odrex Clinic doctors Vitaliy Rusakov and Marina Belotserkovskaya, who are accused of medical negligence, which allegedly led to the death of businessman Adnan Kivan.

Two Odessa doctors have been charged in connection with the death of prominent real estate developer Adnan Kivan.

On Monday, October 28 of last year, Adnan Kivan, owner of the Kadorr Group and publisher of the English-language newspaper Kyiv Post, died at the age of 62.
