The European Commission has filed a lawsuit against Poland for failing to comply with aviation climate regulations

The European Commission has filed a lawsuit against Poland with the Court of Justice of the European Union for failing to comply with the requirements of the updated Climate Action Directive regarding the aviation sector.

This concerns changes to the EU Emissions Trading System (ETS), which provide for the gradual phasing out of free greenhouse gas emission allowances for airlines. From now on, carriers must purchase allowances at market auctions.

The goal of the reform is to reduce harmful emissions and increase the aviation industry’s accountability for its environmental impact.

The deadline for implementing the new rules expired in December 2023, but Poland has yet to adopt the necessary regulations. The draft law intended to introduce these changes has not yet been approved by the government.

In light of this, the European Commission has referred the case to the Court of Justice of the EU and is demanding the imposition of financial penalties.

In the event of further delay, Poland could face both a one-time substantial fine and daily financial penalties for each day of non-compliance.

A decision on the case is not expected for at least two years.

The European Commission has also filed a similar lawsuit against Spain.
