The Supreme Court upheld the decision of the Sixth Administrative Court of Appeal regarding the reinstatement of the construction permit for the H2O residential complex on the territory of the Osokorky Lakes in Kyiv

The cassation appeal was filed by the civic organization “Ecopark Osokorky,” which challenged the appellate court’s ruling of August 15, 2025, to reinstate the construction permit.

This permit had previously been revoked by the Volyn District Administrative Court.

Activists insisted that the site is located within a protected landscape area and that the project allegedly does not comply with Kyiv’s master plan (through 2020), which designates the territory as a public park area, but no environmental impact assessment has been conducted.

At the same time, the current Master Plan designates the area for recreational use, but back in 2009, the Kyiv City Council approved a detailed plan for the area that allows for development.

A building permit was issued in 2018 to the companies “Kontaktbudservice” and “Budevolutsia,” which are affiliated with Arkada Bank. Work was halted in 2019, and since 2021, the project has been continued by Stolitsa Group.

In 2025, sales of apartments in the H2O residential complex began, and currently, facade and utility work is underway on one of the buildings.

The project covers an area of approximately 176 hectares of green space, which was transferred under a long-term lease back in 2005.

Construction of the Arkady residential complex (H2O, “Patriotika,” “Evrika”) was suspended in 2019 due to the bank’s financial problems.

In 2021, a memorandum was signed to complete the construction of the facilities with the participation of a new developer—Stolitsa Group.

Thus, the court ruling effectively upholds the validity of the permit to develop the Osokorky area, despite years of environmental and urban planning disputes surrounding the project.

This was reported by investors from the bankrupt Arkada Bank, which had initiated the project.
