A lawsuit has been filed in Kyiv seeking to protect a water tower

In Kyiv, the prosecutor’s office filed a lawsuit regarding the water tower in the Holosiivskyi district, which has been designated a newly discovered cultural heritage site but has, in fact, remained without adequate legal protection. The request seeks to compel the responsible property manager to enter into a preservation agreement to ensure the preservation of the historic structure.

The structure is an example of 20th-century industrial architecture that forms part of the historic setting of the former estate of the Ukrainian Agricultural Academy and holds significant cultural value for the city.

 

The Kyiv City Prosecutor’s Office has filed a lawsuit demanding that the person authorized by the owner comply with the requirements of cultural heritage protection legislation and enter into a conservation agreement regarding the water tower in the Holosiivskyi district of the capital. Essentially, the goal is to ensure that the site receives proper legal protection, which will allow for monitoring its condition and prevent further neglect.

The prosecutor’s office’s statement notes that the building was added to the list of newly identified cultural heritage sites in Kyiv in early 2023. It is considered a characteristic example of 20th-century industrial architecture and an important part of the historical landscape associated with the Ukrainian Agricultural Academy estate. The structure is approximately 30 meters tall, making it a prominent feature of the local built environment.

Despite this, according to the prosecutor’s office, the entity responsible for the property has long failed to fulfill its obligation to enter into a preservation agreement. It is precisely the absence of such a document, as the office emphasizes, that complicates the proper maintenance of the site and poses risks to its preservation as part of the cultural heritage.

The court has already opened proceedings on this lawsuit, and the matter is now under consideration. The court’s decision will determine whether a legal protection mechanism will be established for the water tower and whether the responsible party will be required to formalize the necessary conservation obligations. This was reported by the Kyiv City Prosecutor’s Office.

The owner of the Lukyanivsky Market in Kyiv, which was damaged during the Russian attack in May, has not yet made a decision regarding its full reconstruction.
