How Krafton’s court case revealed risks of AI misuse in business

In a recent court case involving Krafton, the developer of PUBG, reckless use of artificial intelligence in business was exposed. According to court documents, the company’s director asked ChatGPT to design a strategy aimed at preventing the company from reaching a specific revenue target within the agreed period—a milestone that would have triggered additional payments to previous owners.

The AI recommended blocking the company’s account on the Steam platform to prevent the timely release of Subnautica 2 there. Krafton’s leadership followed this advice and acted accordingly.

The court ruled that ChatGPT’s recommendations had no legal standing, and the company’s actions constituted a breach of business ethics and contractual terms. The case files included excerpts from the director’s correspondence with the AI.

Krafton is a South Korean company known for developing the popular PlayerUnknown’s Battlegrounds (PUBG) game and is among the leading players in the global video game industry. The company focuses on creating and maintaining online games and gaming platforms.

This case highlights the crucial need for oversight in using artificial intelligence in business, as unethical or improper use can lead to legal and reputational consequences. Future AI implementations will require greater attention to legal and ethical considerations.
