The Guarantee Fund is asking the Supreme Court to allow it to join the Ukrinbank case

The Deposit Guarantee Fund for Individuals has once again filed a motion with the Supreme Court requesting to participate in the proceedings regarding the removal of “Ukrinbank” from state supervision. The Fund emphasizes that the outcome of the dispute could affect the return of 1.8 billion hryvnias to the state.

The Fund noted that the Supreme Court refused to allow the parties to participate in the court hearing and plans to hear the case without their participation. In light of this, a motion to be admitted to the proceedings was filed again.

The subject of the dispute is the legality of the actions taken by the former owners of PJSC “Ukrinbank,” who changed the institution’s name to PJSC “Ukrinkom,” altered its legal address, and reclassified it as a non-bank legal entity. According to the Fund’s assessment, this effectively blocked the legally prescribed procedure for the bank’s liquidation and removed its assets from state control.

The Fund also notes that PJSC “Ukrinkom” is currently attempting to undergo bankruptcy proceedings as a non-bank legal entity, which, in their view, does not guarantee adequate protection for creditors.

This involves 1.8 billion hryvnias that the Fund paid out to depositors using state borrowings and which have not yet been returned to the budget.

In addition, the history of “Ukrinbank” has been marked by criminal proceedings. According to the Fund, the bank’s former owner, Volodymyr Klymenko, was charged with abuse of office, forgery of documents, embezzlement on an especially large scale, and fraud. Investigators also suspected him of causing the bank losses of nearly 70 million hryvnias by issuing illegal bank guarantees.

The issue of “Ukrinbank” is also under consideration by the Verkhovna Rada’s Temporary Investigative Commission.

As a reminder, on September 10, the Eastern Commercial Court of Appeal refused to grant the appeal filed by the Deposit Guarantee Fund for Individuals (DGF) and upheld the decision of the Luhansk Regional Commercial Court to open bankruptcy proceedings against PJSC “Ukrainian Innovation Company” and to recognize the claims of LLC “US-Metal” (the initiating creditor) in the amount of 101,200 UAH.
