A victim of the Maidan protests was awarded compensation from the Ministry of Internal Affairs
The Supreme Court of Ukraine has ruled that the Ministry of Internal Affairs must pay compensation to a victim of the actions of the “Berkut” special police unit during the Maidan events. The court ordered the ministry to pay 200,000 hryvnias in compensation for moral damages and confirmed that the state is liable for harm caused to citizens during the Revolution of Dignity.
The state must compensate victims for moral damages suffered during the Revolution of Dignity. The Grand Chamber of the Supreme Court of Ukraine issued the corresponding ruling, according to the Lawyers’ Advisory Group.
On May 27, 2026, the Grand Chamber of the Supreme Court of Ukraine settled the question of “whether the state is liable for harm caused by its representatives, specifically Berkut officers, during the Maidan.” The case concerns the former deputy commander of the Crimean “Berkut”—Chief of Staff Serhiy Marchenko—who was sentenced to 15 years in prison.
The verdict against Marchenko confirmed the illegality of the law enforcement officers’ actions during the storming of Maidan on the night of December 10–11. It also assessed the former law enforcement officer’s treason, as he, in violation of his oath to serve the people of Ukraine, sided with the aggressor country. The court established that on the night of December 10–11, 2013, during the storming of Maidan, as a result of the illegal actions of the Crimean “Berkut” unit under Marchenko’s command, 20 participants in the protest suffered bodily injuries of varying severity and physical pain, the group’s post states.
The victim’s claim against the State, represented by the Ministry of Internal Affairs of Ukraine, for compensation for moral damages was granted.
The Chamber announced the operative part of the decision:
To grant the victim’s claims against the State, represented by the Ministry of Internal Affairs of Ukraine, and to order the State to pay the victim 200,000 UAH from the state budget of Ukraine as compensation for non-pecuniary damage caused by the commission of a crime.
To partially grant the cassation appeal filed by the representative of the Ministry of Internal Affairs;
To deny the victim’s civil claim against the convicted Marchenko (the decisions of the first and appellate instances provided for joint and several compensation from the convicted person and the Ministry of Internal Affairs, and the judgment was amended in this regard).
Thus, the decision of the Grand Chamber of the Supreme Court indicates that the Ministry of Internal Affairs, as a state body, is the proper defendant in cases where harm was inflicted on the victim by Berkut officers during the Revolution of Dignity and this has been proven by the court, the group noted.
