The Rada will consider a bill on the release of those mobilized through unlawful conscription
Bill No. 15119 has been registered in the Verkhovna Rada, which provides for the possibility of discharge from military service for those who have been mobilized if a court has ruled that their conscription was unlawful.
The document proposes amendments to Article 26 of the Law “On Military Duty and Military Service.”
The explanatory note states that the current Article 26 does not provide a mechanism for discharge in cases where circumstances precluding conscription under Article 23 of the Law “On Mobilization Preparation and Mobilization” existed at the time of mobilization or were discovered later.
The authors of the bill emphasize that this violates the principles of legal certainty and equality of citizens. Situations often arise where a conscript who was entitled to a deferment and voluntarily mobilized is subsequently unable to continue service and has no legal right to discharge.
The bill provides that military personnel will be entitled to discharge from service in the following cases:
- if it is confirmed that grounds for deferment existed at the time of mobilization;
- if there is a court ruling recognizing the conscription as unlawful.
As the authors note, this will help avoid violations of the principle of legal certainty, guarantee equality of citizens before the law, and reduce social tension in society.
As a reminder, starting April 1, 2026, a new phase of mobilization administration will begin in Ukraine, involving the full digitization of processes and increased oversight. However, the mobilization model itself remains unchanged.

The Kyiv Regional Territorial Recruitment Center clarified whether a paper military ID is considered valid. By Resolution of the Cabinet of Ministers of Ukraine No. 559 dated May 16, 2024, an electronic military registration document (VRD) was introduced in “Reserve+.”
