The Special Anti-Corruption Prosecutor's Office will appeal the verdict in the case of the accomplice of an SBU counterintelligence officer
The Specialized Anti-Corruption Prosecutor’s Office is preparing an appeal against the June 19 ruling by the High Anti-Corruption Court in the case of Yulia Kondratyeva.
She was charged as an accomplice to Oleksandr Karamushka, the former head of the SBU’s counterintelligence sector, in a case involving the receipt of an unlawful benefit in the amount of 47,500 U.S. dollars.
During the court hearing, the High Anti-Corruption Court reclassified the defendant’s actions from Part 5 of Article 27 and Part 4 of Article 368 to Part 2 of Article 369-2 of the Criminal Code of Ukraine.
As a result, the court sentenced her to three years of imprisonment but immediately released her from serving the sentence due to the expiration of the statute of limitations for criminal prosecution.
The prosecutor from the Specialized Anti-Corruption Prosecutor’s Office (SAPO) considers this court decision unlawful and unfounded, citing evidence gathered during the pretrial investigation.
The prosecution emphasizes that Yulia Kondratyeva was the key organizer of meetings between the complainant and a security service employee, during which the details of receiving bribes from foreign nationals were agreed upon.
According to the case file, Kondratyeva actively encouraged the complainant to seek out foreign nationals willing to pay for the SBU’s non-interference in their activities.
Under her instructions, lists were compiled of individuals who agreed to the criminal terms, and mechanisms were discussed to avoid procedures for revoking residence permits and subsequent deportation from Ukraine.
The prosecution emphasizes that the defendant played an active role in carrying out the scheme, providing specific advice and instructions on how to conceal the criminal activity.
In particular, it was she who proposed setting the amount of the bribe to be collected from each foreign national, to which an SBU employee subsequently agreed.
In addition, it was documented that Kondratyeva was present during the actual receipt of the funds and provided instructions on their distribution.
Moreover, she personally received a portion of the illicit proceeds, which, according to prosecutors, unequivocally demonstrates her complicity in the public official’s acceptance of a bribe.
