A Kyiv-based developer reimbursed 132 million hryvnias in unpaid taxes

A Kyiv-based developer paid nearly 132 million hryvnias in unpaid land tax as part of a pretrial investigation. The case was investigated by detectives from the Economic Security Bureau under the procedural supervision of the Kyiv City Prosecutor’s Office.

“The investigation established that between 2017 and 2024, the company failed to pay land tax for the use of 176 hectares of municipal land allocated for the construction of a residential complex,” the statement reads.

The statement is illustrated with a view of the construction site for a complex of high-rise buildings between Lakes Nebrezh and Tyagle in Kyiv’s Darnytskyi district. The name of the developer has not been disclosed.

At the same time, it is reported that three executives of the company were notified of suspicion of tax evasion on an especially large scale, but during the investigation, the suspects pleaded guilty, and the company paid the full amount of its tax debt, totaling over 132 million hryvnias. “The case materials have been forwarded to the court with a motion to exempt the company’s executives from criminal liability in connection with the full repayment of unpaid taxes,” the Office of the Prosecutor General stated.

As previously reported, in November 2018, the Kyiv District Administrative Court denied a lawsuit filed by the NGO “Ecopark Osokorky” seeking to revoke the State Architectural and Construction Inspection’s (DABI) permit for the construction of the “Patriotika na Ozerakh” residential complex in the “Osokorky-Central” residential area in Kyiv’s Darnytskyi District, issued to “Kontaktbudservice” LLC and “Budevolutsia” LLC. This decision was overturned on appeal in 2019, and later, in 2020, the Supreme Court overturned both of these decisions and remanded the case for reconsideration.

In 2019, members of the Kyiv City Council supported the decision to establish the “Lake Tyagle” Landscape Reserve to preserve valuable natural ecosystems of flora and fauna in the Dnipro floodplain on the capital’s left bank.

Later in 2021, a memorandum was signed for Stolitsa Group LLC to complete the projects of the bankrupt “Arkadia”: the “Eureka,” “Patriotika,” and “Patriotika on the Lakes” residential complexes.

On January 20, 2025, Stolitsa Group launched sales for the “H2O” residential complex in the Osokorky district of Kyiv, located between Lake Tyagle and Lake Nebrezh (formerly the “Patriotika on the Lakes” project by “Arkad”). The project’s lead architect was Oleksiy Kutsalo of “KUB Arhiteks.”

In a ruling dated June 19, 2026, the Supreme Court denied the cassation appeal filed by the NGO “Ecopark Osokorky” and upheld the appellate court’s decision, which had denied the claims seeking to revoke construction permit No. IU113181171313 dated April 27, 2018. The Supreme Court’s decision is final and not subject to appeal. “Thus, at the highest judicial level, the legality of the construction of the ‘H2O’ residential complex and the validity of the relevant permits have been confirmed,” the press release states.

Previously, the Supreme Court also confirmed the validity of the land lease agreement (Case No. 910/10351/20), the legality of the Detailed Territorial Plan (Case No. 826/16737/18), the legality of the urban planning conditions and restrictions (Case No. 640/1406/20), and the legality of the violation report regarding public amenities (Case No. 826/13209/18).

On June 24, 2026, the press service of Stolitsa Group, which had undertaken to complete the problematic projects of the bankrupt Arkada Bank, announced that the Supreme Court had issued a final ruling in Case No. 826/9175/18, confirming the legality of the construction permit for the “H2O” residential complex in Osokorky (formerly known as the “Patriotika na Ozerakh” project).

This was reported on Monday via the Telegram channel of the Office of the Prosecutor General of Ukraine.
