The court ruled that the dismissal of Andriy Kostrytsia from the Supervisory Board of Ukrainian Distribution Networks was unlawful
Andriy Kostrytsia, a former member of the Supervisory Board of JSC "Ukrainian Distribution Networks," has succeeded in having the order terminating his powers declared invalid.
He announced this on his blog, emphasizing that he had defended his position exclusively through the courts.
Kostrytsia became an indirect victim of “Mindichgate”—a corruption scandal at Energoatom. Following the scandal, the government and the president announced a restructuring of key state-owned energy companies and a renewal of the composition of their supervisory boards.
In court, Kostrytsia argued that he had no connection to “Mindichgate” and that his dismissal violated the law. The court of first instance partially granted his claim, ruling the order terminating his powers invalid.
“The court declared the order terminating my powers as a member of the Supervisory Board invalid. This is official confirmation that my position was legally justified, and the actions to terminate my powers were unlawful,” Kostrytsia wrote.
The court did not grant other claims, including the reinstatement of the contract and the invalidation of the order regarding a new competition. Kostrytsia emphasized that his main goal was to prove the illegality of his dismissal and protect his professional reputation, not to retain his position.
He also thanked his legal team and colleagues for their support and noted that the legal proceedings are still ongoing in the higher courts.
