A court exempted a soldier who had not reported for duty for seven months from punishment

In Khmelnytskyi, a court exempted a servicemember from punishment in a case involving nearly seven months of evading military service, during which he worked at a tire shop. The defendant pleaded guilty, expressed remorse, and donated 200,000 hryvnias to the Ukrainian Armed Forces, which was taken into account in the court’s decision.

 

The Khmelnytskyi City and District Court found soldier Vitalii K. guilty of working at a tire shop in the Kyiv region for over seven months instead of performing his military service. The defendant pleaded guilty and donated 200,000 hryvnias to support the Armed Forces of Ukraine. The court sentenced him to five years in prison but suspended the sentence with a two-year probationary period.

According to the July 6 verdict, Vitaliy K. was serving as a reserve soldier in the 106th Reserve Company of a military unit in the Khmelnytskyi region. According to the investigation, from March 11 to November 28, 2025, the servicemember, by agreement with his superiors, worked at the “4 Wheels” tire shop in the city of Vyshhorod, Kyiv Oblast.

At the same time, his absence from the unit was concealed, with officials explaining it as the performance of official duties outside the unit’s deployment area.

In court, Vitaliy K. fully admitted his guilt and expressed remorse. The court took into account that he had no prior convictions, assisted in solving the crime, has a positive character reference, is the sole provider for his young son, and voluntarily donated 200,000 UAH to support the Armed Forces of Ukraine.

Judge Yuriy Demyanov found the serviceman guilty under Part 2 of Article 28, Part 4 of Article 409 of the Criminal Code of Ukraine (evasion of military service committed by prior conspiracy) and sentenced him to five years of imprisonment; however, he was granted a two-year probationary period. The verdict can still be appealed in the court of appeals.
