In Odesa, a military police officer was convicted of the unlawful detention of a man
In Odessa, a court found an officer of the Military Medical Commission (MMC) and the Special Police (SP) guilty of forcibly taking a man to the MMC, along with three other military personnel. According to the case file, tear gas was used against the man, and he was beaten on the way to the TCC. The court sentenced the officer to two years in prison but commuted the sentence to two years of restricted service.
The incident occurred in Odesa on May 2, 2026. At approximately 7:05 p.m., four TCC servicemembers were conducting mobilization activities in the city. According to the case file, they noticed the man but did not identify him or check his documents. The soldiers also failed to determine whether there were legal grounds for his detention. There were no police officers present with them. This is stated in the verdict of the Primorsky District Court of Odesa dated September 28, which was published in the Court Register on September 30.
The soldiers drove up to the man in a Renault Master service vehicle. Upon seeing them, he ran into the entrance of a high-rise building. A TCC officer caught up with the man. Three more soldiers followed him into the building. As noted in the verdict, the man grabbed the metal handrails on the stairs. He tried to resist arrest. One of the soldiers sprayed tear gas in his face.
After that, the man was pulled away from the handrails and forcibly put into a car. The soldiers then took him to the TCC for a medical examination. According to the case file, on the way there, two soldiers beat the man on the torso. They also demanded that he provide his personal information. The court found that an officer was supervising what was happening in the vehicle.
At approximately 7:11 p.m., the man was taken against his will to undergo a military medical examination. The court classified the soldiers’ actions as unlawful deprivation of liberty and kidnapping. The case specifically concerns the actions of the officer who was sentenced.
What sentence did the court impose?
The officer fully admitted his guilt. He entered into a plea agreement with the prosecutor. The victim did not object to the approval of this agreement. The court found the servicemember guilty under Part 1 of Article 28 and Part 2 of Article 146 of the Criminal Code of Ukraine. He was initially sentenced to two years of imprisonment. However, the court replaced this sentence with two years of restricted military service.
Additionally, during this period, 10% of his pay must be remitted to the state. Separately, the court lifted the round-the-clock house arrest that had previously been imposed on the defendant. The verdict is not yet final. It may be appealed to the appellate court within 30 days of the date of pronouncement.
