The Supreme Court upheld the seizure of an apartment belonging to the family of a TCC official
The Supreme Court of Ukraine has definitively upheld the legality of the seizure of an apartment used by the family of the deputy head of the Poltava Regional Territorial Control Commission and its transfer to the state. The property in question was deemed an unjustified asset due to the lack of documented income to support its purchase.
In the case regarding the possible illegal enrichment of the TCC official, the Supreme Court put an end to the matter, agreeing with the decision of the court of first instance and confirming that the apartment in Poltava must be confiscated as state revenue. The property in question is a three-bedroom apartment in the city center valued at over 1.9 million hryvnias, which is formally registered in the name of the official’s mother but was actually used by him and his family.
This was reported by the Specialized Anti-Corruption Prosecutor’s Office, which emphasized that the court deemed the asset unjustified due to the owner’s lack of sufficient legal income to purchase it. “This concerns a three-bedroom apartment in the central part of Poltava valued at over 1.9 million hryvnias. In 2023, the official’s mother purchased this property without having sufficient legal income to do so. At the same time, it was established that the apartment is actually used by the official and his family members,” the SAPO statement reads.
As prosecutors established, the High Anti-Corruption Court initially granted the claim and recognized the asset as unjustified, but the appellate court overturned that decision. Following this, the prosecutor’s office appealed the ruling to the Supreme Court, and the Supreme Court sided with the prosecution, definitively confirming the seizure of the property. “The Supreme Court’s decision is final and not subject to appeal,” the SAPO emphasizes.
The case materials also note that the lawsuit was based on data from the National Agency for Corruption Prevention, as well as additional evidence gathered by the prosecutor through lawful procedures.
Thus, the state has definitively secured the right to seize real estate that the court deemed an unjustified asset, regardless of the formal registration of ownership. This was reported by the Specialized Anti-Corruption Prosecutor’s Office (SAPO).
