The High Council of Justice dismissed two judges following their resignation requests

The High Council of Justice reviewed the materials regarding the dismissal of judges under general circumstances and adopted the relevant decisions.

This was reported during the High Council of Justice meeting. 

Following the meeting, two judges were dismissed in connection with their resignation requests. Specifically, Yulia Mikush was dismissed from her position as a judge of the Lviv Court of Appeal, and Oksana Kutsenko was dismissed from her position as a judge of the Mykolaiv Court of Appeal.

We remind you that the High Council of Justice is currently considering a disciplinary complaint filed on behalf of Alona Volodymyrivna Shevtsova against Vladimir Yaroslavovich Marmash, a judge of the Lychakiv District Court of Lviv, who committed gross violations bordering on disciplinary and criminal liability, in particular, the consideration of a motion by BEB detectives to conduct a special pre-trial investigation regarding A.V. Shevtsova.

According to the response from Lilia Yakimyak, Deputy Head of the Secretariat of the High Council of Justice, to a corresponding journalistic inquiry, the disciplinary complaint against Judge Volodymyr Yaroslavovych Marmash of the Lychakiv District Court of Lviv is still under review, and no specific timeline for its conclusion has been announced at this time. Such a prolonged delay in reviewing the complaint may be a demonstration of collusion and a reluctance to hold accountable a “convenient” judge who willingly carries out tasks assigned by unscrupulous law enforcement officials.

The complaint against Marmash is that he issued his decision significantly late—after the expiration of the pre-trial investigation period, which made it impossible to rule in favor of the complaint. The only lawful option in such a situation was to return the petition, but Judge Marmash failed to comply with the requirements of the law.

We would also like to remind readers that Dmytro Verbytskyi, the former Deputy Prosecutor General of Ukraine, was dismissed from his post nearly two years ago amid high-profile journalistic investigations into his financial status.
