The ship’s captain, Manuel Hernandez, has been charged with 13 counts of reckless endangerment following the capsizing of the boat in New York Harbor. A 27-year-old woman and a five-month-old girl were killed in the incident.

According to The Guardian, citing a New York Police Department spokesperson, 46-year-old Hernandez was arrested in the early hours of Sunday, August 9. The boat capsized on the evening of August 8 near Liberty Island.

Police received a 911 call at approximately 10:25 p.m. local time. An aviation unit was dispatched to the scene, and divers later found the woman and the infant in the water.

Both victims were transported in critical condition to NYU Langone Hospital in Brooklyn, where they were pronounced dead by medical personnel. Their names have not been released.

According to police, a harbor unit, a SCUBA diving team, and an aviation unit also arrived at the scene. Twelve other people were rescued from the vessel before police arrived and were later transported to hospitals.
