Court upholds seizure of car worth 3.3 million hryvnias from Ministry of Justice official
The Supreme Court has ruled that the seizure of a car worth 3.3 million hryvnias from an official at the Ministry of Justice of Ukraine was lawful. According to the case file, the vehicle was registered in the name of the official’s daughter, but the investigation determined that it was actually purchased for the official’s benefit. The court’s decision upheld the confiscation of the vehicle as an unjustified asset.
This was reported by the Specialized Anti-Corruption Prosecutor’s Office and the National Agency for the Prevention of Corruption.
The Supreme Court confirmed the legality of the seizure of the unjustified asset used by Vadym Kirienko, head of the Ministry of Justice’s Southeast Interregional Directorate for the Enforcement of Criminal Sentences.
"The Civil Cassation Court within the Supreme Court confirmed the legality of the decisions of the courts of first and appellate instances of the High Anti-Corruption Court, which upheld the SAPO prosecutor’s claim to recognize the asset used by the department head as unjustified and to confiscate its value as state revenue (civil forfeiture).
The asset in question is a 2021 LAND ROVER RANGE ROVER VOQUE, valued at 3,290,400 UAH on the date of acquisition, which the official’s daughter purchased in 2023 on his behalf.
"It has been proven that the official could indirectly perform actions with this asset that are equivalent in substance to the right to dispose of it. The court agreed with the prosecutor’s arguments and denied the cassation appeal," the statement reads.
The Supreme Court’s decision is final and not subject to appeal.
The lawsuit was filed based on materials from the National Agency for Corruption Prevention (NAZK), the State Bureau of Investigations, and evidence independently obtained by the prosecutor in accordance with the law.
