US court blocks Trump administration’s birthright citizenship restrictions

A federal court in the District of Maryland issued a preliminary injunction blocking the implementation of the latest executive order by Donald Trump’s administration to restrict the right to US citizenship by birth. Federal authorities have been prohibited from denying citizenship to members of a court-certified class of plaintiffs, Anadolu Agency reports.

Effect of the injunction

The ruling states that authorities also may not take other actions that impede the recognition of citizenship for members of this group, result in its denial, or lead to its non-recognition.

The preliminary injunction applies, in particular, to the US Department of State, the Department of Justice and the Department of Homeland Security. At the same time, the court stated that during the suspension of the order, the government may issue public explanations regarding certain provisions of the policy.

Previous Supreme Court decision

The 2026 order provided for expanding the categories of people not entitled to automatically receive US citizenship and was also aimed against so-called “birth tourism.”

As the agency notes, in June the US Supreme Court overturned a previous attempt to end birthright citizenship. At that time, Chief Justice John Roberts confirmed that the 14th Amendment to the US Constitution protects all children born in the country.
