Miami court denies Tate brothers bail over flight risk
US Magistrate Judge Lauren Louis in Miami denied influencers Andrew and Tristan Tate release on bail while they challenge extradition to the United Kingdom. The judge said the brothers’ wealth and frequent international travel indicate a high risk that they could flee, Dawn reports.
In her written ruling, Louis said that even if the brothers do not actually own all the assets they display on social media, the case materials demonstrate their exceptional ability to leave US jurisdiction. The Tates’ lawyers said they would continue defending the brothers against the allegations and would take part in proper legal procedures in every jurisdiction.
Arguments of the parties
Earlier, the defense argued in court filings that the brothers’ high public profile would make fleeing impractical. Their lawyers described posts in which they displayed wealth as theatrical and exaggerated.
Prosecutors from the US Attorney’s Office in Miami said there is a strong presumption in favor of detention in international extradition cases. They also argued that if released, the brothers could pose a danger to the community, citing British allegations that victims were strangled during forced rapes.

At a hearing in Miami federal court on August 27, prosecutors showed a video in which Andrew Tate used derogatory language about women. Both brothers told the court that they were playing online personas when they made crude comments. Louis also noted that the nature of the allegations against them indicates a potential danger to the community.
Extradition to the United Kingdom
Andrew Tate, 39, and Tristan Tate, 38, were arrested in Miami on July 18 following a UK extradition request. The brothers hold dual US and UK citizenship. The British side is seeking their surrender to consider charges of rape, assault, and facilitating human trafficking for sexual exploitation. The brothers deny any wrongdoing.
According to court documents, the United Kingdom has until September 16 to submit a full extradition request to the US State Department. The procedure may take several months. New charges by the UK Crown Prosecution Service concern alleged crimes against four victims between July 2010 and August 2017. The brothers had previously also been named in UK allegations of rape and human trafficking involving three victims.
The Tates have been under investigation in Romania since 2022. Romanian prosecutors have formally charged Andrew Tate with trafficking minors, money laundering, sexual relations with a minor, and influencing witnesses, while Tristan Tate has been charged with complicity. Their lawyer in Romania said the brothers reject these charges.
