Private companies in Ukraine must re-confirm their status as “critically important” by September 1, 2026. Without doing so, they will lose the right to exempt their employees from mobilization. These requirements are set forth in the updated regulations approved by the Cabinet of Ministers.

The new criteria primarily apply to private businesses. For most companies whose industry- or region-specific criteria have not changed, a simplified procedure applies. By August 10, they must submit a certificate of their employees’ average wages and a tax calculation.

Starting in July, new requirements regarding average wages were introduced for businesses. As a general rule, the average wage must be at least 25,941 hryvnias, and for companies located in frontline territories, 21,618 hryvnias. Failure to comply with these requirements may result in the loss of critical enterprise status.

The standard reservation quota remains at up to 50% of employees subject to military service; however, for enterprises in the defense-industrial complex, the energy sector, and certain companies in frontline regions, it may reach 100%.

An employee cannot process the deferment on their own—only the employer may submit the documents. The validity of the deferment can be verified via the “Reserve+” app, which displays the deferment status, its validity period, and the employer.

Legal experts predict that after the transition period ends, the number of reserved employees may temporarily decrease due to the need to reconfirm the status of enterprises.
