The EU has never required that the Prosecutor General be selected through a competitive process
Claims by certain civil society activists regarding international partners’ demands concerning personnel competitions are manipulative.
This was stated by members of the National Association of Lobbyists of Ukraine during a professional discussion on reforming the legal profession in Ukraine.
In particular, there are no provisions in the official documents of European institutions requiring a mandatory competition for the position of Prosecutor General or Head of the National Police.
Experts on European integration note that the European community respects the sovereign right of each state to independently determine its domestic policy.
However, some domestic grant-funded organizations use the names of international donors to advance their own interests. They attempt to obstruct the work of judicial and law enforcement agencies by invoking fictitious demands from the West.
“The European Union has not made any demands regarding a competitive selection process for the position of Prosecutor General. The European Union has not made any demands regarding the competitive selection of the head of the National Police, because in Europe they understand what external interference in the work of the state authorities of an independent country entails,” emphasized Oleksiy Shevchuk, head of the lobbyists’ association.
The legal community points out that any personnel appointments must take place exclusively within the framework of Ukraine’s current constitution.
Attempts to change this procedure through pressure from interested activist groups pose a threat to national security.
All legislative initiatives must undergo thorough analytical review in parliament, rather than being adopted under the influence of loud slogans.
