Draft Law Submitted to Parliament to Ban Forced Mobilization

Serhiy Hryvko, a People’s Deputy from the “Servant of the People” party, has registered a draft law in the Verkhovna Rada of Ukraine proposing amendments to the law “On Mobilization Preparation and Mobilization.” This was reported with reference to the parliament’s website.

The draft aims to regulate the procedure for checking citizens’ military registration documents and serving summons, and it prohibits representatives of the Territorial Recruitment and Social Support Centers (Territorial Recruitment and Social Support Centerss) from using physical force or special equipment against those liable for military service.

According to the explanatory note, since the start of Russia’s full-scale armed aggression, properly organizing mobilization processes has become critically important for ensuring the country’s defense capability. At the same time, there have been instances of violations of legislation during mobilization.

“Gaps, contradictions, and ambiguities in the legal regulation of these processes lead to inconsistent application of the law, conflicts between citizens and Territorial Recruitment and Social Support Centers officers, violations of citizens’ rights, numerous court cases, and reduced effectiveness of mobilization measures,” the document states.

The deputy proposes that citizens be summoned to the Territorial Recruitment and Social Support Centers either through direct delivery of the summons or via registered mail with a delivery confirmation.

Additionally, during checks of military registration documents and the serving of summons, Territorial Recruitment and Social Support Centers representatives and police officers must not unjustifiably use physical force or special equipment against those liable for service. At the same time, police are obliged to prevent violations and respond to any illegal actions, regardless of who commits them.
