Even with a deferral, you may still be fined by the TCC
The Eighth Administrative Court of Appeals upheld a fine of 17,000 hryvnias imposed on a man subject to military service for failing to appear at the Territorial Military Registration and Enlistment Office in response to a summons.
The court found that the summons had been sent by certified mail to the address the man himself had provided when updating his military registration information. The letter was returned with a note stating that the addressee was not present, which the court deemed sufficient proof of notification.
The man challenged the fine, arguing that he had not received the summons and was granted a deferment from mobilization due to caring for his mother. However, the court emphasized that the deferment does not exempt him from the obligation to appear when summoned by the Territorial Military Commissariat and to comply with military registration rules.
As a result, the appellate court upheld the decision of the court of first instance and the ruling imposing the fine.
