The Shevchenkivskyi District Court of Kyiv sentenced Mykhailo Marchuk, a colonel with the State Security Service of Ukraine, to 10 years in prison for the murder of Lieutenant Colonel Kostiantyn Khomenko.
The court found Marchuk guilty of intentional murder.
The case concerns events on the night of February 10, 2022, when Lieutenant Colonel Kostiantyn Khomenko of the State Security Service was killed in Kyiv.
According to the investigation, a conflict arose between Khomenko, Mykhailo Marchuk, and another lieutenant colonel while they were vacationing together. The argument escalated into a fight in one of the rooms.
During the conflict, Marchuk fired a targeted shot at the victim with his own Beretta 92 Compact pistol, caliber 9×19 mm.
The resulting injury proved fatal. Khomenko suffered damage to his spine, spinal cord, and blood vessels, which led to his death.
The defendant did not admit guilt and claimed he acted in self-defense. According to him, during the struggle, he allegedly lost control of the weapon, after which the shot was fired.
However, the court rejected this version of events.
During the trial, the court examined the testimony of more than 20 witnesses, CCTV footage, crime scene reports, and forensic, genetic, and ballistic expert analyses.
As a result, the court concluded that Marchuk acted with direct intent.
After handing down the verdict, the court also ruled to lift the seizure of the defendant’s property.
Specifically, the seizure was lifted from non-residential basement premises with an area of 309 m², half of a residential building and outbuildings, two apartments with a total area of 93.1 m², and a 2008 Skoda Octavia.
The deceased’s wife demanded that the defendant be ordered to pay 5 million hryvnias in moral damages.
The court partially granted the claim and ordered Marchuk to pay 3 million hryvnias in moral damages.
The verdict has not yet taken legal effect and may be appealed.
Earlier, a Zaporizhzhia court sentenced a 59-year-old woman to nine years in prison for trafficking her own child for the purpose of exploitation. She handed her 12-year-old son over to a stranger for forced begging.
