The court ordered the TCC to remove the entry regarding the violation of military registration from Reserve+
The Dnipropetrovsk District Administrative Court ruled that it was unlawful to enter information regarding a violation of military registration rules into the Unified State Register of Conscripts without holding the individual administratively liable, and ordered the Territorial Military Registration and Enlistment Office to delete the relevant entry.
The plaintiff filed a lawsuit after seeing a flag in the “Reserve+” app indicating a violation of military registration rules, along with information that the Territorial Military Commissariat had contacted the police to have him brought in. However, no administrative report had been drawn up against him, nor had any decision been issued to hold him accountable.
During the hearing, the man explained that he had repeatedly informed the Territorial Registration Center about undergoing treatment for an incurable illness, had sent medical documents, and had notified the center that he was unable to appear in person at the Territorial Registration Center.
The court concluded that the law permits the entry into the Registry only of information regarding administrative liability that has already been formally imposed under Articles 210 or 210-1 of the Code of Administrative Offenses. The mere fact of a possible violation of military registration rules, without a written report or ruling, does not constitute a legal basis for entering such information.
As a result, the court fully granted the claim, ordered the Territorial Military Registration and Enlistment Office to remove the entry from the Register, and awarded the plaintiff 968.96 UAH in court fees.
