The High Anti-Corruption Court sentenced the former head of Poltavapalyva to pay 12.7 million hryvnias in damages to the community

The High Anti-Corruption Court found Mykola Horyaschenko, the former acting director of the municipal enterprise “Poltavapalyvo,” guilty of abuse of office, which caused losses to the local community amounting to over 12.7 million hryvnias.

As established by the court, in June 2020, the head of the enterprise, without consulting the Poltava Regional Council, entered into an agreement with a private company to provide repayable financial assistance in the amount of 1.89 million hryvnias for a period of one month, knowing that these funds could not be repaid.

Later, the official signed a settlement agreement under which the municipal enterprise was to either repay the debt or transfer real estate of equivalent value to the private company.

Subsequently, without the property owner’s consent, six industrial buildings with auxiliary structures located in Poltava, Kremenchuk, Lubny, as well as in the Kozelshchyna, Mashiv, and Reshetylivka districts of Poltava Oblast were transferred.

The property was transferred to private ownership at an estimated value of approximately 1.8 million UAH. At the same time, expert appraisals established that its actual market value was over 14.5 million UAH.

The court found the former official guilty under Part 2 of Article 364 of the Criminal Code of Ukraine and sentenced him to 3 years and 4 months of imprisonment.

In addition, he was barred from holding positions involving organizational, managerial, administrative, or economic functions for one year and was fined 8,500 UAH.

The verdict has not yet entered into legal force and may be appealed within 30 days.
