Petr Pavel, President of the Czech Republic, has officially filed a lawsuit with the country’s Constitutional Court against the current government. The lawsuit was prompted by the Cabinet’s categorical refusal to include the head of state—a former high-ranking NATO official—in the national delegation to the Alliance’s July summit

The conflict arose against the backdrop of a political standoff between the president and Prime Minister Andrej Babiš, who was previously Pavel’s main rival in the presidential election. 

The head of government announced that he would personally lead the Czech delegation to the summit in Ankara, scheduled for July 7–8, alongside the ministers of foreign affairs and defense. Babiš called his decision “pragmatic,” explaining that it was necessary to defend the government’s position, particularly regarding the reduction of the Czech Republic’s defense spending. In addition, Babiš’s cabinet has recently significantly reduced support for Ukraine, while Petr Pavel remains a consistent and resolute supporter of the country.

In his lawsuit challenging the cabinet’s authority, Petr Pavel demands a clear demarcation and clarification of the constitutional powers of the president and the government regarding the representation of the republic on the international stage. He called the cabinet’s actions unprecedented and extremely ill-advised, emphasizing that throughout the country’s history, presidents have led Czech delegations at 19 out of 20 NATO summits, and the sole exception was due exclusively to the health condition of the leader at the time. The Czech Constitutional Court confirmed receipt of the complaint and promised to consider it as a matter of priority; however, it is currently unknown whether the judges will be able to reach a verdict before the start of the NATO summit. Under the current Czech Constitution, the president’s powers are limited, and the general course of foreign policy is determined exclusively by the cabinet.
