A U.S. court has dismissed Elon Musk's lawsuit against OpenAI and its co-founders Sam Altman and Greg Brockman, in which the billionaire sought their removal and the restoration of the organization's nonprofit status.

This was reported by Bloomberg.

Elon Musk lost his lawsuit against OpenAI and its leadership. In the lawsuit he filed in 2024, the businessman claimed that Altman and Brockman allegedly misled him during the company’s founding, convincing him to invest in the project as a charitable initiative aimed at developing artificial intelligence for the benefit of humanity. 

Subsequently, according to Musk, OpenAI’s structure was changed to a commercial one, which he considered a violation of the initial agreements. On this basis, he demanded that the company’s executives be dismissed and that the reorganization be reversed, restoring its status as a nonprofit organization.

The trial lasted three weeks, during which all key parties to the case testified. Musk claimed in court that his “charitable organization had been stolen,” while Altman and Brockman criticized him, accusing him of an authoritarian and inconsistent management style. Brockman also asserted that the billionaire does not understand artificial intelligence.

When it was founded in 2015, OpenAI was conceived as a cooperative, non-profit project by Silicon Valley visionaries to develop artificial intelligence technologies. Initial funding of approximately $1 billion was provided by Elon Musk, Peter Thiel, Amazon, Microsoft, and other prominent investors and technology companies. The idea was that the organization would simultaneously achieve a breakthrough in AI and ensure its development under control for the public good. It was expected that OpenAI, as a non-profit entity, would publish its findings openly, and investors would not receive priority access to the results.

However, this model did not last long. In its early years, OpenAI did not show significant results, and by 2018, Musk had lost patience, telling Altman that the company was significantly lagging behind Google. He offered to buy out the project, but after being refused, he withdrew from it and stopped funding it. After that, OpenAI’s leadership began to change its approach and create parallel structures that allowed it to attract investment—Microsoft eventually became the largest investor.
