The Prosecutor's Office will appeal the verdict against a former Kyiv City Council member in the traffic accident case
The prosecutor's office will appeal the verdict against a former Kyiv City Council member whom the court found guilty of causing a traffic accident that resulted in serious bodily injury to a pedestrian.
This was reported by the Kyiv City Prosecutor’s Office.
According to reports, following the public prosecution by prosecutors from the Kyiv City Prosecutor’s Office, the Obolon District Court of Kyiv found the woman guilty of violating traffic rules, resulting in the victim sustaining serious injuries.
The prosecution insisted that the driver was under the influence of drugs at the time of the accident. This conclusion is based on the findings of a narcologist’s examination, as well as a toxicological analysis, which confirmed the presence of cannabis metabolites in her system.
In light of this, the prosecutor asked the court to classify the defendant’s actions under Part 2 of Article 286-1 of the Criminal Code of Ukraine and impose a sentence of 6 years and 6 months of imprisonment, along with a 8-year ban on driving.
However, the court reclassified the defendant’s actions from the article on driving under the influence of drugs to Part 2 of Article 286 of the Criminal Code of Ukraine, which does not provide for such an aggravating factor.
As a result, the court sentenced the woman to 5 years of imprisonment with a 3-year ban on driving vehicles. At the same time, pursuant to Article 75 of the Criminal Code of Ukraine, she was released from serving her sentence with a 3-year probationary period.
The prosecutor’s office stated that it disagrees with the court’s decision and will appeal the verdict.
As a reminder, former Kyiv City Council member Yaryna Ar’ieva, who was accused of causing a traffic accident while under the influence of drugs with serious consequences, received a suspended sentence.
