A court in Kyiv has ordered the removal of a large parking lot in Troyeshchyna

The Kyiv Commercial Court has ruled in favor of the Kyiv City Prosecutor’s Office in its lawsuit seeking the return to the community of a land plot on Honoré de Balzac Street, which a private company had been illegally using as a parking lot. The court ruling requires the commercial entity not only to vacate the nearly 0.8-hectare municipal land plot but also to completely demolish all structures erected on it without authorization. 

This was reported by the press service of the Kyiv City Prosecutor’s Office.

The reason for the court proceedings was a violation by the Kyiv City Council, which leased this territory in violation of land legislation and without conducting the required open land auction. Having obtained the plot through this procedure, the company built real estate there and subsequently sold it to another firm, which was headed by the same individual.

A prosecutor’s investigation revealed that the buildings in question are illegal, as the city authorities never issued permits for capital construction at this location to either the first or the second company. The district prosecutor’s office promptly filed a lawsuit demanding the removal of obstacles to the disposal of municipal property and the annulment of the unlawful registration of ownership rights, and the court fully upheld the law enforcement agencies’ position.

Previously, the appellate court overturned an illegal decision by the Bucha District Council, and the 3,000-hectare Bilychansky Forest was returned to the Kyiv community.

Also, after nearly five years of litigation, a complex of historic buildings dating from 1830 to 1910, located in the historic part of Podil near Zamkova Hill, was returned to the Kyiv community.
