A businesswoman will stand trial in Kyiv for illegal construction on community-owned land

In Kyiv, an indictment has been filed against an individual entrepreneur accused of unauthorized construction on an illegally occupied plot of land in the “Sobache Girlo” estuary in Obolon. The case was investigated by prosecutors from the Obolon District Prosecutor’s Office in the capital.

 

It was established that the sole proprietor occupied part of a land plot belonging to the water resources fund, erecting wooden and metal gazebos, a fence, and other auxiliary structures on it without permits. The area of the unlawfully occupied land plot, which is located within the water protection zone and the coastal protection strip of the “Sobache Girlo” estuary of the Dnipro River, is 0.1480 hectares. 

This land plot belongs to the water fund, is municipally owned, and must be used exclusively for cultural, health, recreational, sports, and tourism purposes, as stipulated by its designated use.

According to the law, on plots located within the water protection zone and the riparian protection strip of rivers, the construction of any structures is prohibited, except for hydraulic engineering structures, navigational structures, hydrometric structures, and linear structures.

The actions of the accused businesswoman have been classified under Part 4 of Article 197-1 of the Criminal Code of Ukraine. Prosecutors are also taking measures to clear the land plot of the unauthorized structures, according to the Kyiv City Prosecutor’s Office.
