Land in the Zhukiv Island Nature Reserve has been returned to the Kyiv community
The Prosecutor’s Office successfully argued before the Supreme Court that the transfer of a land plot within the “Zhukiv Island” nature reserve to private ownership was unlawful. Pursuant to the court’s decision, the plot was returned to the ownership of the Kyiv territorial community.
In the case brought by the Specialized Environmental Prosecutor’s Office of the Kyiv City Prosecutor’s Office, courts of three instances agreed with the prosecutors’ position and ruled to return to the local community the land plot partially located within the waters of the Dnipro River estuary and within the “Zhukiv Island” landscape reserve of local significance.
This 0.0932-hectare plot, located in the Holosiivskyi district of Kyiv, was transferred by the Kyiv City Council in 2009 to private ownership of an individual for the construction and maintenance of a residential building, farm buildings, and structures.


Subsequently, based on purchase and sale agreements, it was repeatedly transferred, including to a citizen of the Russian Federation.
At the same time, the Specialized Environmental Prosecutor’s Office established that the disputed land plot is located within the boundaries of the “Zhukiv Island” landscape reserve of local significance, established in 1999 by a decision of the Kyiv City Council. It belongs to the water and nature reserve funds of Ukraine. Such lands cannot be transferred to private ownership or used for construction.

Consequently, the prosecutor’s office filed a lawsuit seeking to halt the illegal use of the land plot belonging to the water and nature reserve funds and to return it to the capital’s community.
The Supreme Court has now definitively upheld the legitimacy of the prosecutor’s office’s claims, affirming the decisions of the lower courts, according to the press service of the Kyiv City Prosecutor’s Office.
Previously, a businesswoman had illegally developed a plot in Holosiivskyi Park.
