Google unveils Gemini 3.8 Flash, while court does not order sale of AdX

Google has unveiled the Gemini 3.8 Flash AI model and the specialized cybersecurity model Gemini 3.8 Flash Cyber. On the same day, a federal judge in the United States rejected the Department of Justice’s request to sell the AdX advertising exchange. As CNBC Top News reports, these events occurred after Alphabet’s longest monthly losing streak on Wall Street in more than a decade.

On Wednesday, Alphabet shares rose by 0.6%. At the same time, after falling by more than 1% on Tuesday, at the beginning of the month, they still remained slightly below their level at the start of September.

Gemini models and pricing

Gemini 3.8 Flash became the third Flash model released by Google in six weeks. The company calls it its best Gemini model for reasoning and programming and says it improves software development and the completion of multistep tasks. The model focuses, among other things, on code writing and agentic tasks.

Gemini 3.8 Flash costs 75 cents per million input tokens and $3.75 per million output tokens, the same as the previous Flash model at launch. For Gemini Enterprise, Google is adding pay-as-you-go billing, token discounts of up to 20%, monthly spending limits for agents, and a $0 basic subscription option.

According to Google, nearly three-quarters of Google Cloud customers already use its AI products, and their spending is about 50% above their initial commitments. D.A. Davidson analyst Gil Luria told CNBC that the new model helps Google remain competitive but, in his view, will not change its position as a distant third player in the enterprise market behind Anthropic and OpenAI.

Cybersecurity and the AdX case

According to Google, Gemini 3.8 Flash Cyber can detect and fix software vulnerabilities with performance at the level of leading models, while operating faster and more cheaply than larger models. Because of potential misuse, the company will initially provide access to a small group of vetted government and corporate cyber defense specialists through the Fairwind program.

In the U.S. Department of Justice’s advertising technology case against Google, the judge ruled not to require the company to sell the AdX exchange. Instead of the structural separation sought by regulators, the court chose behavioral measures. Last year, another judge also rejected a request to force Google to separate its Chrome browser.

Berkshire Hathaway CEO Greg Abel told CNBC that the company considers Alphabet one of the winners in artificial intelligence, particularly given the use of Google technologies at Berkshire portfolio companies. Google’s advertising business grew by 14% in the latest quarter.
