The Special Prosecutor's Office has returned more than 8,000 hectares of land to the state
The Zhytomyr Specialized Prosecutor's Office for Defense Affairs in the Central Region has successfully challenged in court the illegal transfer of a large tract of land to a private entity.
According to the court’s decision, more than 8,000 hectares of defense land, previously used as hunting grounds, must be returned to the state.
The subject of the court proceedings was an area of 8,417.4 hectares, which the Zhytomyr Regional Council had previously transferred for use to a public organization of hunters and fishermen.
The lease term, according to preliminary agreements, was to be 25 years; however, prosecutors uncovered gross violations of the law.
During the hearings, representatives of the Special Prosecutor’s Office demonstrated that the use of defense-designated land for hunting operations directly contradicts the provisions of the Land Code of Ukraine.
Furthermore, such actions violate the requirements of the Law of Ukraine “On the Use of Defense Lands,” which is unacceptable under current conditions.
The court upheld the prosecutors’ position, declaring the agreements on hunting operations in this territory invalid.
The civic organization was officially ordered to vacate the plot and return it to the Housing and Maintenance Department of the city of Zhytomyr.
