The court ordered the demolition of unauthorized structures in the Gorbachikha area
The Northern Commercial Court of Appeals upheld the decision of the trial court, which had granted the claim filed by the Dnipro District Prosecutor’s Office of Kyiv.
The defendant organization was ordered to demolish a complex of buildings with a total area of 500 square meters that had been illegally constructed on land designated as a water reserve.
The land plot itself is located in a protected area of the capital and is of strategic importance for the city’s ecology.
This includes four residential buildings, a separate security building, and a number of utility buildings.
All these structures were illegally built on a plot with a total area of nearly 13 hectares, the market value of which exceeds 50 million hryvnias.
Initially, ownership of the property was registered in the name of an individual based on a controversial arbitration court decision and a ruling by the Boryspil City and District Court of Kyiv Oblast.
Subsequently, the illegal properties were transferred to a public organization and later to a service cooperative through the conclusion of purchase and sale agreements.
Prosecutors proved in court that construction was carried out without any permits on land belonging to the communal property of the Kyiv community.
The property owners attempted to legalize their buildings and gain control over the valuable land in the capital through various means.
